Joseph Loloi Biography

Mr. Loloi joined Kishner Miller Himes as an associate in May 2016. Prior to joining the firm, Mr. Loloi worked as an Assistant District Attorney at the Bronx County District Attorney’s Office for four and a half years.

As an Assistant District Attorney, Mr. Loloi prosecuted hundreds of cases ranging from simple violations to violent felonies. Mr. Loloi also served among a select group of prosecutors responsible for investigating corporate criminality in the context of construction worker fatalities, handling DNA based prosecutions and prosecuting serious vehicular crimes.  Mr. Loloi handled several jury trials for the District Attorney’s Office, including homicide and armed robbery cases.

Currently, Mr. Loloi concentrates on civil litigation, particularly for complex business and commercial disputes as well as real estate litigation. He also handles criminal defense matters.  In the recent past, he has represented clients charged with vehicular crimes, and in each instance he achieved a favorable plea.

Mr. Loloi also handles residential and commercial real estate transactions, mainly major property sales, purchases, and leasing. He represents both landlords and tenants in landlord-tenant matters throughout New York City.

Mr. Loloi handles all facets of litigation, including motion practice, trials and appeals. He represents larger corporations, small businesses and individuals in a variety of business disputes, including complex commercial cases. His experience as both a trial lawyer and transactional lawyer gives Mr. Loloi a unique perspective that well serves his clients. In particular, Mr. Loloi applies his practical experiences from business and real estate transactions, together with his trial experience from government service, to develop effective litigation and trial strategies for the firm’s clients.

Representative Matters

Commercial and Real Estate Litigation

  • Represented the purchaser of a new-construction condominium unit in a lawsuit against the condominium sponsor and the sponsor’s principals asserting major construction defects, resulting in favorable settlement prior to trial
  • Represented a landlord in eviction proceedings involving the holdover stay of a licensee who refused to leave the premises, resulting in the successful eviction of the licensee
  • Represented an individual in proceedings under the real property laws involving a license agreement for a neighboring condominium developer’s construction work, resulting in a favorable court order
  • Represented condominium unit owners in special proceedings involving testimony by expert witnesses on proposed major construction work

Transactional Matters

  • Represented several buyers of multi-million-dollar condominium units, handling each transaction from contract negotiation through closing
  • Represented the purchaser of numerous commercial properties in The Bronx, from contract negotiation through closing, as well as preparing all related corporate documents for the purchase

Criminal Matters/Highlights

  • Negotiated plea agreements and subsequent guilty pleas on hundreds of cases, ranging from petit larceny to attempted murder
  • Presented hundreds of cases to grand juries resulting in indictments for significant criminal prosecutions
  • Handled a bench trial on charges that the defendant assaulted police officers, which resulted in a conviction and subsequent sentence imposing a substantial period of incarceration
  • Handled a jury trial on charges that the defendant participated in an armed robbery, which resulted in a conviction and the imposition of a substantial incarceration sentence
  • Conducted an investigation into assault allegations, which involved finding previously missing surveillance evidence and locating previously undisclosed witnesses, resulting in all charges against the defendant being withdrawn
  • Conducted an investigation into the workplace death of a cement truck operator to determine whether the employee’s company should be charged with a crime, which involved analysis of corporate compliance with governmental safety guidelines, resulting in the conclusion that no corporate criminality had occurred
  • Participated in the investigation, prosecution and eventual guilty plea for burglary charges established through the use of DNA evidence
